A registered trademark is not a finished job

The day your trademark is registered is not the day the work stops. Over the years that follow, several things can happen — and each one carries a deadline:

What can happen after registration

  • Renewals come due. A UK trademark lasts ten years and must be actively renewed. The renewal window opens six months before expiry. Miss it, and your protection can lapse — recoverable for a while with a surcharge, but lost entirely if the late window also passes.
  • Opposition windows open. When a new mark similar to yours is published, there is a short, fixed window in which to oppose it. The window does not wait for you to notice.
  • Conflicting marks get filed. Someone may apply to register a mark close to yours, in a class that overlaps with your business. The sooner you know, the more options you have.
  • Statuses change. A monitored mark's status on the register can change for reasons worth knowing about.

What it does not do

File a renewal for you, lodge an opposition on your behalf, or advise you on whether to oppose a conflicting mark. Those are actions and decisions for you and your trademark attorney.

What monitoring is — and is not

Avanti Notum's monitoring is an alerting service. It watches the registers and tells you, promptly, when something relevant to a mark you care about happens. It does not file a renewal for you, lodge an opposition on your behalf, or advise you on whether to oppose a conflicting mark. Those are decisions and actions for you and your trademark attorney. What monitoring guarantees is that you will not be caught out by a deadline you did not see coming.
